PREAMBLE AND DEFINITIONS

These Terms and Conditions of Service (hereinafter referred to as "Terms," "Agreement," "Terms of Service," or "ToS") constitute a legally binding contractual agreement between you, whether acting in your individual capacity, as an agent, representative, or on behalf of any entity, organization, institution, or corporate body (collectively referred to as "User," "you," "your," "Subscriber," "Registrant," or "Account Holder") and the operators, administrators, licensors, service providers, and affiliated entities of the Unime.Space educational technology platform (hereinafter referred to as "Unime.Space," "Platform," "Service," "we," "us," "our," "Company," "Service Provider," or "Provider").

By accessing, browsing, navigating, utilizing, interacting with, downloading content from, uploading content to, registering an account with, authenticating through, subscribing to, or otherwise engaging with any aspect, feature, functionality, interface, application programming interface (API), endpoint, service, sub-service, component, module, or derivative work of the Unime.Space platform, whether through web-based interfaces, mobile applications, desktop applications, API integrations, third-party applications, automated systems, scripts, bots, or any other method of access or interaction, you hereby acknowledge, represent, warrant, and agree that you have read, understood, comprehended, and fully accept, without reservation, qualification, condition, or limitation, all of the terms, conditions, provisions, stipulations, requirements, restrictions, limitations, obligations, responsibilities, liabilities, disclaimers, exclusions, waivers, releases, indemnifications, and other legal and contractual obligations set forth in this Agreement.

If you do not agree to be bound by these Terms in their entirety, or if you are unable or unwilling to comply with any provision contained herein, you must immediately cease all use of the Service, terminate any existing account, and refrain from accessing or utilizing any aspect of the Platform. Your continued use of the Service following the posting of modifications, amendments, or updates to these Terms shall constitute your acceptance of such modifications, amendments, or updates, regardless of whether you have reviewed or are aware of such changes.

For purposes of clarity and legal precision, the following definitions shall apply throughout this Agreement:

"Content" means any and all data, information, text, graphics, images, photographs, videos, audio files, multimedia content, documents, files, code, scripts, software, applications, user-generated content, posts, comments, messages, communications, submissions, uploads, downloads, test responses, solutions, answers, questions, assessments, evaluations, feedback, ratings, reviews, likes, subscriptions, preferences, settings, configurations, metadata, tags, labels, categories, classifications, and any other material, whether in digital, electronic, or any other form, that is created, uploaded, posted, submitted, transmitted, shared, stored, processed, analyzed, or otherwise made available through or in connection with the Service.

"User Content" means any Content that is created, uploaded, posted, submitted, transmitted, shared, or otherwise provided by you or on your behalf, including but not limited to posts, comments, files, test submissions, profile information, biographical data, avatars, banners, and any other material originating from or attributable to you.

"Platform Content" means any Content that is owned, controlled, licensed, or provided by Unime.Space, including but not limited to the Service itself, its features, functionality, design, layout, user interface, graphics, logos, trademarks, service marks, proprietary algorithms, software, code, documentation, and any other material not constituting User Content.

"Account" means the unique user account, profile, identity, authentication credentials, access credentials, and associated data, settings, preferences, and configurations that are created, maintained, and associated with a registered user of the Service.

"Service" means the Unime.Space educational technology platform, including but not limited to all websites, web applications, mobile applications, APIs, backend systems, databases, servers, infrastructure, networks, software, hardware, services, features, functionality, tools, resources, content, and any other components, whether currently existing or developed in the future, that are provided, operated, maintained, or made available by Unime.Space.

"Intellectual Property" means all intellectual property rights, including but not limited to copyrights, trademarks, service marks, trade names, trade dress, patents, patent applications, trade secrets, know-how, proprietary information, confidential information, database rights, moral rights, publicity rights, privacy rights, and any other intellectual or industrial property rights, whether registered or unregistered, and whether existing now or in the future, anywhere in the world.


SECTION 0: TRADEMARK DISCLAIMER AND INSTITUTIONAL NON-AFFILIATION

0.1 Use of "Unime" in Domain Name and Branding

The Service operates under the domain name "unime.space" (accessible at https://www.unime.space) and may utilize the term "Unime Space" or variations thereof in its branding, marketing materials, user interface, documentation, or other communications. You acknowledge and agree that the use of the term "Unime" or any variation thereof in connection with the Service, including but not limited to the domain name, branding, or other identifiers, is for descriptive, referential, or nominative purposes only and does not indicate, imply, suggest, or otherwise represent any form of affiliation, association, connection, partnership, sponsorship, endorsement, authorization, approval, sanction, or official relationship with the Università degli Studi di Messina (University of Messina), its administrators, faculty, staff, employees, agents, representatives, affiliates, subsidiaries, or any other entity, organization, or institution associated with or related to the University of Messina.

0.2 Absence of Institutional Affiliation

Unime.Space, the operators of the Service, and all parties involved in the creation, development, operation, maintenance, or provision of the Service hereby expressly disclaim, deny, and repudiate any and all forms of affiliation, association, connection, partnership, sponsorship, endorsement, authorization, approval, sanction, or official relationship with the Università degli Studi di Messina (University of Messina), its administrators, faculty, staff, employees, agents, representatives, affiliates, subsidiaries, or any other entity, organization, or institution associated with or related to the University of Messina. The Service is an independent, student-initiated, student-operated, and student-maintained platform that has been created, developed, and operated by students of the University of Messina for the benefit of their peers, fellow students, and other members of the academic community, without any official authorization, endorsement, sponsorship, or support from the University of Messina or any of its constituent parts, departments, divisions, or administrative units.

0.3 Fan Group and Community Nature

The Service is operated as a fan group, student community initiative, peer-to-peer educational resource, or similar informal, non-official, and independent endeavor created by students for students. The Service is not an official service, product, or offering of the University of Messina, and the University of Messina has no responsibility, liability, or obligation with respect to the Service, its content, its operation, its availability, its functionality, or any aspect thereof. The Service is provided on a voluntary, non-commercial (or limited commercial), community-driven basis, and the operators of the Service act in their individual capacities as students and members of the academic community, not as agents, representatives, or employees of the University of Messina.

0.4 No Endorsement or Authorization

The University of Messina has not endorsed, authorized, approved, sanctioned, sponsored, or otherwise provided any form of official support, recognition, or approval for the Service, its operators, its content, its features, its functionality, or any aspect thereof. Any reference to the University of Messina, its name, its trademarks, its service marks, its trade names, or any other identifiers associated with the University of Messina in connection with the Service is purely referential, descriptive, or nominative in nature and does not constitute, imply, or suggest any form of endorsement, authorization, approval, sanction, sponsorship, or official relationship.

0.5 Compliance with Trademark Rights and Immediate Name Change

Unime.Space and the operators of the Service acknowledge and respect the intellectual property rights, including but not limited to trademark rights, service mark rights, trade name rights, and other proprietary rights, that the Università degli Studi di Messina (University of Messina) may hold in connection with the term "Unime," "UniMe," "UNIME," or any variation, derivative, or combination thereof. Unime.Space and the operators of the Service hereby agree and covenant that, in the event that the University of Messina, its authorized representatives, or any party with legitimate standing to assert rights in connection with the term "Unime" or any variation thereof, determines, asserts, claims, or provides notice that the use of such term in connection with the Service, including but not limited to the domain name "unime.space," the branding "Unime Space," or any other use of such term, violates, infringes, or otherwise conflicts with any single right, multiple rights, or combination of rights held by the University of Messina, including but not limited to trademark rights, service mark rights, trade name rights, or any other intellectual property rights, Unime.Space and the operators of the Service will immediately, without delay, hesitation, or objection, cease all use of such term, change the domain name, rebrand the Service, and take all necessary and appropriate actions to comply with such determination, assertion, claim, or notice, including but not limited to: (a) discontinuing use of the domain name "unime.space" and any variations thereof; (b) removing, deleting, or modifying all references to "Unime," "Unime Space," or any variations thereof from the Service, its branding, its marketing materials, its user interface, its documentation, and all other communications; (c) selecting and implementing an alternative domain name, branding, or identifier that does not incorporate or reference the term "Unime" or any variation thereof; and (d) taking any other actions that may be reasonably required or requested to address such determination, assertion, claim, or notice.

0.6 No Waiver of Rights

Nothing in this Section 0 shall be construed as: (a) a waiver, release, or abandonment of any rights that the University of Messina may hold in connection with the term "Unime" or any variation thereof; (b) an admission, acknowledgment, or recognition that Unime.Space or the operators of the Service have any right, title, or interest in or to the term "Unime" or any variation thereof; (c) a grant, license, or permission to use the term "Unime" or any variation thereof; or (d) a limitation, restriction, or constraint on the ability of the University of Messina to assert, enforce, or protect its rights in connection with the term "Unime" or any variation thereof.

0.7 User Acknowledgment

By accessing or using the Service, you acknowledge and agree that: (a) the Service is not affiliated with, endorsed by, or authorized by the University of Messina; (b) the Service is an independent, student-initiated, and student-operated platform; (c) the University of Messina has no responsibility, liability, or obligation with respect to the Service; (d) any use of the term "Unime" or any variation thereof in connection with the Service is purely referential, descriptive, or nominative in nature; (e) you will not rely on any perceived or implied affiliation, association, or relationship between the Service and the University of Messina; and (f) you understand that the Service may be required to change its name, domain name, or branding at any time if the University of Messina asserts rights in connection with such terms.

0.8 Limitation of Liability Regarding Institutional Disclaimers

Unime.Space and the operators of the Service shall not be liable for any loss, damage, or harm arising from: (a) any misunderstanding, confusion, or misperception regarding the relationship between the Service and the University of Messina; (b) any reliance on a perceived or implied affiliation, association, or relationship between the Service and the University of Messina; (c) any actions taken by the University of Messina in connection with the Service, including but not limited to requests for name changes, trademark enforcement actions, or other legal proceedings; or (d) any changes to the Service's name, domain name, branding, or identifiers that may be required as a result of assertions of rights by the University of Messina or other parties.


SECTION 1: ACCEPTANCE OF TERMS AND MODIFICATIONS

1.1 Binding Nature of Agreement

These Terms constitute a legally binding contract between you and Unime.Space. By accessing or using the Service, you acknowledge that you have the legal capacity, authority, and competence to enter into this Agreement. If you are accessing or using the Service on behalf of an entity, organization, or institution, you represent and warrant that you have the full legal authority, power, and authorization to bind such entity, organization, or institution to these Terms, and that all actions taken by you in connection with the Service are within the scope of such authority.

1.2 Modifications and Updates

Unime.Space reserves the absolute, unrestricted, and unilateral right, in its sole and absolute discretion, at any time, with or without prior notice, to modify, amend, update, revise, supplement, alter, change, or otherwise edit these Terms, in whole or in part, for any reason or no reason whatsoever, including but not limited to changes in applicable law, changes in the Service, changes in business practices, changes in technology, or any other reason deemed appropriate by Unime.Space. Such modifications may include, without limitation, the addition of new terms, the modification of existing terms, the deletion of terms, the restructuring of terms, or any combination thereof.

You acknowledge and agree that it is your sole responsibility to regularly review these Terms to stay informed of any modifications, amendments, or updates. Unime.Space may, but is not obligated to, provide notice of material changes to these Terms through various means, including but not limited to email notifications, in-service notifications, pop-up messages, banner announcements, or other communication methods. However, the absence of such notice shall not affect the validity or enforceability of any modifications to these Terms.

Your continued use of the Service following the posting of any modifications to these Terms shall constitute your acceptance of such modifications. If you do not agree to any modifications to these Terms, your sole and exclusive remedy is to immediately cease all use of the Service and terminate your Account in accordance with the procedures set forth in these Terms.

1.3 Additional Terms and Policies

In addition to these Terms, your use of the Service is also governed by other policies, terms, conditions, guidelines, rules, and agreements that may be posted, referenced, or linked to from the Service, including but not limited to Privacy Policies, Cookie Policies, Community Guidelines, Acceptable Use Policies, Content Policies, Data Processing Agreements, and any other applicable terms or conditions. All such additional terms, policies, and conditions are hereby incorporated by reference into these Terms and shall have the same force and effect as if fully set forth herein.

In the event of any conflict, inconsistency, or contradiction between these Terms and any additional terms, policies, or conditions, these Terms shall govern to the extent of such conflict, inconsistency, or contradiction, unless the additional terms, policies, or conditions explicitly state otherwise and are signed by an authorized representative of Unime.Space.


SECTION 2: ELIGIBILITY AND ACCOUNT REGISTRATION

2.1 Eligibility Requirements

The Service is intended for use by individuals who are at least thirteen (13) years of age, or the age of majority in their jurisdiction of residence, whichever is greater. By accessing or using the Service, you represent and warrant that you meet the minimum age requirement and that you have the legal capacity, competence, and authority to enter into this Agreement and to use the Service in accordance with these Terms.

If you are under the age of majority in your jurisdiction, you represent and warrant that you have obtained the express consent, authorization, and permission of your parent or legal guardian to access and use the Service, and that your parent or legal guardian has read, understood, and agreed to these Terms on your behalf. Unime.Space reserves the right to request proof of age, parental consent, or legal guardianship at any time, and failure to provide such proof may result in the immediate suspension or termination of your Account.

2.2 Account Registration and Authentication

To access certain features, functionality, or areas of the Service, you may be required to register for an Account and provide certain information, including but not limited to your name, username, email address, password, and other information as may be requested by Unime.Space from time to time. You agree to provide accurate, current, complete, and truthful information during the registration process and to update such information promptly whenever it changes or becomes inaccurate, incomplete, or outdated.

You are solely responsible for maintaining the confidentiality, security, and integrity of your Account credentials, including your username, password, email address, and any other authentication information or access credentials associated with your Account. You agree not to share, disclose, transfer, sell, lease, license, or otherwise make available your Account credentials to any third party, and you acknowledge that you are fully responsible for all activities, actions, transactions, and conduct that occur under your Account, whether authorized or unauthorized.

2.3 Email Verification and OTP Authentication

Unime.Space may require you to verify your email address through a one-time password (OTP) verification process or other authentication mechanisms as determined by Unime.Space in its sole discretion. You agree to cooperate with such verification processes and to provide accurate and current contact information. Failure to complete email verification or OTP authentication may result in limitations on your access to certain features of the Service or the suspension or termination of your Account.

2.4 Account Security and Unauthorized Access

You agree to immediately notify Unime.Space of any unauthorized access, use, or disclosure of your Account, password, or any other breach of security that you become aware of. Unime.Space shall not be liable for any loss, damage, or harm arising from your failure to comply with this obligation or from any unauthorized access to or use of your Account, regardless of whether such unauthorized access or use results from your negligence, the actions of third parties, security vulnerabilities, system failures, or any other cause.

You acknowledge and agree that Unime.Space may, in its sole discretion, monitor, log, track, record, and analyze your Account activity, login attempts, authentication events, access patterns, usage statistics, and other information related to your use of the Service for security, fraud prevention, compliance, and other legitimate business purposes.

2.5 Account Termination and Suspension

Unime.Space reserves the right, in its sole and absolute discretion, at any time, with or without prior notice, to suspend, restrict, limit, disable, deactivate, or terminate your Account, or to refuse, restrict, or limit your access to or use of the Service, in whole or in part, for any reason or no reason whatsoever, including but not limited to: (a) violation of these Terms or any other applicable policies; (b) fraudulent, illegal, or unauthorized activity; (c) abuse, harassment, or harmful conduct; (d) infringement of intellectual property rights; (e) violation of applicable laws or regulations; (f) technical issues or system maintenance; (g) business reasons; or (h) any other reason deemed appropriate by Unime.Space.

You may terminate your Account at any time by following the procedures set forth in the Service or by contacting Unime.Space. Upon termination of your Account, your right to access and use the Service will immediately cease, and Unime.Space may, in its sole discretion, delete, remove, or retain your Account information, User Content, and other data associated with your Account, in accordance with applicable law and Unime.Space's data retention policies.


SECTION 3: USER CONDUCT AND ACCEPTABLE USE

3.1 General Conduct Requirements

You agree to use the Service only for lawful purposes and in accordance with these Terms and all applicable laws, regulations, rules, ordinances, statutes, codes, standards, guidelines, and requirements of any governmental authority, regulatory body, or self-regulatory organization having jurisdiction over you, the Service, or your use of the Service.

You agree not to use the Service in any manner that: (a) violates any applicable law, regulation, rule, ordinance, statute, code, standard, guideline, or requirement; (b) infringes, violates, or misappropriates the rights of any third party, including but not limited to intellectual property rights, privacy rights, publicity rights, or contractual rights; (c) is fraudulent, deceptive, misleading, or false; (d) is harmful, threatening, abusive, harassing, defamatory, libelous, slanderous, vulgar, obscene, pornographic, profane, indecent, or otherwise objectionable; (e) promotes or facilitates illegal activities, violence, discrimination, hatred, or bigotry; (f) interferes with, disrupts, or damages the Service, servers, networks, or systems; (g) attempts to gain unauthorized access to any portion of the Service, other accounts, computer systems, or networks; (h) uses automated systems, scripts, bots, crawlers, scrapers, or other automated tools to access, collect, or extract data from the Service without Unime.Space's express written consent; (i) impersonates any person or entity, or falsely states or misrepresents your affiliation with any person or entity; (j) collects, stores, or transmits personal information about other users without their express consent; (k) spams, floods, or otherwise overwhelms the Service or other users; or (l) violates any other provision of these Terms.

3.2 Content Standards and Restrictions

You agree that all User Content that you create, upload, post, submit, transmit, or otherwise make available through the Service shall: (a) be accurate, truthful, and not misleading; (b) comply with all applicable laws, regulations, and these Terms; (c) not infringe, violate, or misappropriate any rights of any third party; (d) not contain any viruses, malware, spyware, adware, Trojan horses, worms, or other harmful or malicious code; (e) not contain any material that is defamatory, libelous, slanderous, harassing, threatening, abusive, vulgar, obscene, pornographic, profane, indecent, or otherwise objectionable; (f) not promote or facilitate illegal activities, violence, discrimination, hatred, or bigotry; (g) not contain any personal information about third parties without their express consent; and (h) not violate any other provision of these Terms or any applicable policies.

Unime.Space reserves the right, but not the obligation, to monitor, review, screen, filter, edit, modify, remove, delete, or refuse to accept or display any User Content, in whole or in part, for any reason or no reason whatsoever, including but not limited to violations of these Terms, applicable laws, or Unime.Space's policies. Unime.Space does not endorse, support, represent, or guarantee the accuracy, completeness, reliability, or quality of any User Content, and you acknowledge that you may be exposed to User Content that is inaccurate, offensive, indecent, objectionable, or otherwise inappropriate.

3.3 Prohibited Activities

You agree not to engage in any of the following prohibited activities: (a) reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code, algorithms, or underlying ideas of the Service; (b) modifying, adapting, altering, or creating derivative works of the Service without Unime.Space's express written consent; (c) removing, obscuring, or altering any copyright, trademark, or other proprietary notices or labels on or in the Service; (d) using the Service to transmit, distribute, or store any material in violation of any applicable law or regulation; (e) using the Service to transmit, distribute, or store any material that infringes the intellectual property rights of any third party; (f) using the Service to transmit, distribute, or store any material that contains viruses, malware, or other harmful code; (g) attempting to gain unauthorized access to any portion of the Service, other accounts, computer systems, or networks; (h) interfering with or disrupting the Service, servers, or networks connected to the Service; (i) using automated systems, scripts, bots, crawlers, scrapers, or other automated tools to access, collect, or extract data from the Service without Unime.Space's express written consent; (j) impersonating any person or entity, or falsely stating or misrepresenting your affiliation with any person or entity; (k) collecting, storing, or transmitting personal information about other users without their express consent; (l) spamming, flooding, or otherwise overwhelming the Service or other users; (m) using the Service for any commercial purpose without Unime.Space's express written consent; or (n) engaging in any other activity that Unime.Space, in its sole discretion, determines to be harmful, inappropriate, or in violation of these Terms.

3.4 Enforcement and Consequences

Unime.Space reserves the right, but not the obligation, to investigate any suspected violation of these Terms or any misuse of the Service, and to take any action that Unime.Space, in its sole discretion, deems appropriate, including but not limited to: (a) issuing warnings; (b) suspending or terminating your Account; (c) restricting or limiting your access to certain features or areas of the Service; (d) removing, deleting, or disabling access to User Content; (e) reporting violations to law enforcement authorities; (f) pursuing legal action; or (g) taking any other action permitted by law or these Terms.

You acknowledge and agree that Unime.Space's failure to enforce any provision of these Terms shall not constitute a waiver of such provision or of Unime.Space's right to enforce such provision or any other provision of these Terms in the future.


SECTION 4: INTELLECTUAL PROPERTY RIGHTS

4.1 Ownership of Platform Content

All Platform Content, including but not limited to the Service itself, its features, functionality, design, layout, user interface, graphics, logos, trademarks, service marks, proprietary algorithms, software, code, documentation, and any other material not constituting User Content, is owned, controlled, or licensed by Unime.Space or its licensors, and is protected by copyright, trademark, patent, trade secret, and other intellectual property laws and international treaties.

You acknowledge and agree that Unime.Space and its licensors retain all right, title, and interest in and to the Platform Content, including all intellectual property rights therein. Nothing in these Terms shall be construed as granting you any right, title, or interest in or to the Platform Content, except for the limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service in accordance with these Terms.

4.2 License to Use Service

Subject to your compliance with these Terms, Unime.Space grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your personal, non-commercial, educational purposes, in accordance with these Terms and as permitted by the functionality of the Service. This license does not include any right to: (a) resell, redistribute, or commercially exploit the Service or any portion thereof; (b) modify, adapt, alter, or create derivative works of the Service; (c) reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, or underlying ideas of the Service; (d) remove, obscure, or alter any copyright, trademark, or other proprietary notices or labels on or in the Service; or (e) use the Service for any purpose other than as expressly permitted by these Terms.

4.3 User Content License Grant

By creating, uploading, posting, submitting, transmitting, or otherwise making available any User Content through the Service, you hereby grant to Unime.Space and its affiliates, subsidiaries, partners, licensors, licensees, and service providers a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, fully paid-up, transferable, sublicensable license to use, reproduce, distribute, display, perform, modify, adapt, create derivative works of, translate, publish, and otherwise exploit such User Content, in whole or in part, in any form, format, or medium, whether now known or hereafter developed, for any purpose, including but not limited to: (a) providing, operating, maintaining, and improving the Service; (b) developing, marketing, and promoting the Service; (c) creating and distributing marketing materials, advertisements, and promotional content; (d) conducting research, analytics, and data analysis; (e) complying with legal obligations; and (f) any other purpose deemed appropriate by Unime.Space in its sole discretion.

You represent and warrant that you have all necessary rights, licenses, permissions, and authorizations to grant the foregoing license, and that your User Content does not infringe, violate, or misappropriate any rights of any third party, including but not limited to intellectual property rights, privacy rights, publicity rights, or contractual rights.

4.4 Moral Rights and Attribution

To the extent permitted by applicable law, you hereby waive any and all moral rights, droit moral, or similar rights that you may have in or to your User Content, and you agree not to assert any such rights against Unime.Space or its affiliates, subsidiaries, partners, licensors, licensees, or service providers. Unime.Space is not obligated to provide attribution to you for your User Content, but may do so in its sole discretion.

4.5 Intellectual Property Infringement

Unime.Space respects the intellectual property rights of others and expects users to do the same. If you believe that any Content on the Service infringes your intellectual property rights, you may submit a notice of infringement to Unime.Space in accordance with Unime.Space's intellectual property infringement policy, which may be updated from time to time.

Unime.Space reserves the right to remove or disable access to any Content that Unime.Space, in its sole discretion, determines to be infringing or in violation of intellectual property rights, and to terminate the Accounts of users who repeatedly infringe the intellectual property rights of others.


SECTION 5: PRIVACY AND DATA PROTECTION

5.1 Privacy Policy

Your privacy is important to Unime.Space. The collection, use, storage, processing, disclosure, and protection of your personal information, data, and privacy are governed by Unime.Space's Privacy Policy, which is incorporated by reference into these Terms. By using the Service, you consent to the collection, use, storage, processing, disclosure, and protection of your personal information, data, and privacy as described in the Privacy Policy.

5.2 Data Collection and Use

7.1 Testing Services Overview

The Service provides various testing, assessment, and evaluation services, including but not limited to multiple-choice questions (MCQ), open-ended questions, algorithmic challenges, data structures and algorithms (DSA) assessments, and other types of tests, quizzes, examinations, or assessments (collectively, "Tests"). You acknowledge and agree that Unime.Space provides these testing services for educational and informational purposes only, and that the results, scores, grades, feedback, or other outcomes of such Tests (collectively, "Test Results") are provided on an "as is" basis without any warranties, representations, or guarantees of any kind.

7.2 Test Participation and Submission

By participating in, taking, or submitting responses to any Test, you acknowledge and agree that: (a) you will provide accurate, truthful, and complete responses to the best of your knowledge and ability; (b) you will not engage in any form of cheating, fraud, deception, or academic dishonesty, including but not limited to using unauthorized materials, accessing prohibited resources, collaborating with others when collaboration is not permitted, or otherwise attempting to gain an unfair advantage; (c) you will not share, disclose, or distribute Test questions, answers, solutions, or other Test content to any third party without Unime.Space's express written consent; (d) you will not attempt to reverse engineer, decompile, or otherwise analyze Test questions, answers, or grading algorithms; and (e) you will comply with all applicable rules, guidelines, and instructions related to the Test.

7.3 Automatic and Manual Grading

Tests may be graded automatically using algorithms, software, or other automated systems, or may be graded manually by instructors, administrators, or other authorized personnel. You acknowledge and agree that: (a) automatic grading systems may not be perfect and may contain errors, inaccuracies, or limitations; (b) manual grading may be subjective and may vary depending on the grader; (c) Test Results may be subject to review, revision, or correction at any time; (d) Unime.Space does not guarantee the accuracy, completeness, reliability, or fairness of any Test Results; and (e) Test Results are provided for informational and educational purposes only and should not be relied upon as the sole basis for any academic, professional, or personal decisions.

7.4 Code Execution and Algorithmic Challenges

Certain Tests may require you to write, submit, or execute code, scripts, or programs, particularly in connection with algorithmic challenges or DSA assessments. You acknowledge and agree that: (a) any code, scripts, or programs that you submit may be executed, analyzed, or evaluated by Unime.Space or its service providers in secure, isolated, or sandboxed environments; (b) Unime.Space may monitor, log, record, or analyze your code submissions for security, fraud prevention, plagiarism detection, or other purposes; (c) Unime.Space is not responsible for any errors, bugs, vulnerabilities, or security issues in your code submissions; (d) Unime.Space may impose restrictions on the types of code, libraries, functions, or operations that may be used in code submissions; and (e) Unime.Space reserves the right to reject, refuse, or disable any code submissions that Unime.Space, in its sole discretion, determines to be inappropriate, harmful, or in violation of these Terms.

7.5 Test Results and Performance Data

Unime.Space may collect, store, process, analyze, and use your Test Results, performance data, progress logs, and other information related to your participation in Tests for various purposes, including but not limited to: (a) providing, operating, maintaining, and improving the Service; (b) personalizing your experience and recommending Tests or content; (c) conducting research, analytics, and data analysis; (d) generating reports, statistics, or insights; (e) detecting, preventing, and addressing fraud, cheating, or academic dishonesty; and (f) any other purpose described in the Privacy Policy or as otherwise permitted by applicable law.

You acknowledge and agree that Unime.Space may share, disclose, or make available your Test Results, performance data, or other information to instructors, administrators, educational institutions, or other authorized parties, as determined by Unime.Space in its sole discretion or as required by applicable law.

All Test questions, answers, solutions, content, and materials (collectively, "Test Content") are owned, controlled, or licensed by Unime.Space or its licensors, and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws. You acknowledge and agree that you have no right, title, or interest in or to any Test Content, except for the limited right to access and use such Test Content in connection with taking Tests in accordance with these Terms.

You agree not to copy, reproduce, distribute, display, perform, modify, adapt, create derivative works of, translate, publish, or otherwise exploit any Test Content, in whole or in part, without Unime.Space's express written consent. You further agree not to share, disclose, or distribute Test Content to any third party without Unime.Space's express written consent.


SECTION 8: DISCUSSION BOARDS, POSTS, AND COMMENTS

8.1 Discussion Boards and Community Features

The Service provides discussion boards, forums, posts, comments, and other community features (collectively, "Community Features") that allow users to create, share, discuss, and interact with content and other users. You acknowledge and agree that: (a) Community Features are public or semi-public spaces where your content may be visible to other users; (b) Unime.Space does not endorse, support, represent, or guarantee the accuracy, completeness, reliability, or quality of any content posted in Community Features; (c) you may be exposed to content that is inaccurate, offensive, indecent, objectionable, or otherwise inappropriate; and (d) you use Community Features at your own risk.

The Service may allow you to like, subscribe to, follow, or otherwise interact with posts, comments, boards, tests, users, or other content or entities. You acknowledge and agree that: (a) such interactions are public or may be visible to other users; (b) Unime.Space may use information about your interactions for various purposes, including personalization, analytics, and recommendations; (c) you are solely responsible for your interactions with other users and content; and (d) Unime.Space is not responsible for the conduct, content, or actions of other users.

8.4 Content Moderation and Removal

Unime.Space reserves the right, but not the obligation, to monitor, review, screen, filter, edit, modify, remove, delete, or refuse to accept or display any Community Content, in whole or in part, for any reason or no reason whatsoever, including but not limited to violations of these Terms, applicable laws, or Unime.Space's policies. You agree not to settle any matter subject to indemnification by you without Unime.Space's prior written consent.

Unime.Space may, in its sole and absolute discretion, at any time, with or without prior notice, suspend, restrict, limit, disable, deactivate, or terminate your Account, or refuse, restrict, or limit your access to or use of the Service, in whole or in part, for any reason or no reason whatsoever, including but not limited to: (a) violation of these Terms or any other applicable policies; (b) fraudulent, illegal, or unauthorized activity; (c) abuse, harassment, or harmful conduct; (d) infringement of intellectual property rights; (e) violation of applicable laws or regulations; (f) technical issues or system maintenance; (g) business reasons; or (h) any other reason deemed appropriate by Unime.Space.

11.3 Effect of Termination

Upon termination of your Account or your access to the Service: (a) your right to access and use the Service will immediately cease; (b) Unime.Space may, in its sole discretion, delete, remove, or retain your Account information, User Content, and other data associated with your Account, in accordance with applicable law and Unime.Space's data retention policies; (c) any licenses or rights granted to you under these Terms will immediately terminate; (d) you will remain liable for all obligations, responsibilities, and liabilities that accrued prior to termination; and (e) the provisions of these Terms that by their nature should survive termination shall survive termination, including but not limited to Sections 4 (Intellectual Property Rights), 5 (Privacy and Data Protection), 9 (Disclaimers and Limitations of Liability), 10 (Indemnification), 12 (Dispute Resolution), and 13 (General Provisions).

11.4 Survival

The provisions of these Terms that by their nature should survive termination shall survive termination, including but not limited to provisions regarding intellectual property rights, privacy and data protection, disclaimers and limitations of liability, indemnification, dispute resolution, and general provisions.


SECTION 12: DISPUTE RESOLUTION

12.1 Governing Law

If such negotiations are unsuccessful, you and Unime.Space agree to submit such dispute, controversy, or claim to binding arbitration in accordance with the rules of Camera Arbitrale di Milano, except as otherwise provided in these Terms.

12.3 Arbitration

Any dispute, controversy, or claim arising out of or in connection with these Terms or your use of the Service that cannot be resolved through good faith negotiations shall be settled by binding arbitration in accordance with the rules of Camera Arbitrale di Milano. The arbitration shall be conducted in Italy, in the English language, and shall be administered by Camera Arbitrale di Milano. The arbitrator's decision shall be final and binding, and judgment on the arbitrator's award may be entered in any court having jurisdiction thereof.

12.4 Class Action Waiver

You and Unime.Space agree that any dispute, controversy, or claim arising out of or in connection with these Terms or your use of the Service shall be resolved on an individual basis, and you agree not to bring, join, or participate in any class action, collective action, or representative action against Unime.Space. You waive any right to participate in any class action, collective action, or representative action against Unime.Space.

12.5 Exception for Injunctive Relief

Notwithstanding the foregoing, Unime.Space may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights, to prevent unauthorized access to or use of the Service, or to enforce these Terms, without first engaging in the dispute resolution process set forth above.

13.1 Entire Agreement

13.5 Relationship of Parties

If you provide feedback, suggestions, comments, ideas, or other input regarding the Service, including but not limited to Beta Features, you acknowledge and agree that: (a) such feedback, suggestions, comments, ideas, or input are provided voluntarily and without expectation of compensation or other consideration; (b) Unime.Space may use, modify, adapt, incorporate, or otherwise exploit such feedback, suggestions, comments, ideas, or input in any manner, without any obligation to you; (c) you grant to Unime.Space a perpetual, irrevocable, non-exclusive, royalty-free, fully paid-up, transferable, sublicensable license to use, reproduce, distribute, display, perform, modify, adapt, create derivative works of, and otherwise exploit such feedback, suggestions, comments, ideas, or input; and (d) you waive any and all rights, claims, or interests that you may have in or to such feedback, suggestions, comments, ideas, or input.

18.3 No Obligation to Implement

Unime.Space is under no obligation to implement, incorporate, or otherwise use any feedback, suggestions, comments, ideas, or input that you provide, and Unime.Space may, in its sole discretion, choose to implement, incorporate, or use such feedback, suggestions, comments, ideas, or input in any manner, or not at all, without any obligation to you.


SECTION 19: DATA EXPORT AND PORTABILITY

19.1 Data Export Rights

Subject to applicable law and Unime.Space's data retention policies, you may have the right to export, download, or otherwise obtain a copy of certain data associated with your Account, including but not limited to your User Content, profile information, test results, and other data. You acknowledge and agree that: (a) such export, download, or data portability features may be subject to limitations, restrictions, or technical constraints; (b) Unime.Space may, in its sole discretion, determine the format, scope, and method of data export, download, or portability; (c) you are solely responsible for maintaining backup copies of your data; and (d) Unime.Space is not obligated to provide data export, download, or portability features, except as required by applicable law.

19.2 Data Format and Compatibility

If Unime.Space provides data export, download, or portability features, you acknowledge and agree that: (a) exported, downloaded, or portable data may be provided in formats that are determined by Unime.Space in its sole discretion; (b) such formats may not be compatible with all software, applications, or systems; (c) you are solely responsible for ensuring that you have the necessary software, applications, or systems to access, view, or use exported, downloaded, or portable data; and (d) Unime.Space is not responsible for the compatibility, usability, or functionality of exported, downloaded, or portable data with any particular software, application, or system.

19.3 Data Retention and Deletion

Unime.Space may retain your data for as long as necessary to provide the Service, comply with legal obligations, resolve disputes, enforce these Terms, or for other legitimate business purposes. Upon termination of your Account or your request for data deletion, Unime.Space may, in its sole discretion, delete, remove, or retain your data in accordance with applicable law and Unime.Space's data retention policies. You acknowledge and agree that: (a) Unime.Space is not obligated to delete or remove your data immediately upon termination of your Account or your request for data deletion; (b) some data may remain in Unime.Space's systems for extended periods of time, including in backup systems, archives, or other storage systems; and (c) Unime.Space may be required by law to retain certain data for specified periods of time.


SECTION 20: COMPLIANCE WITH LAWS AND REGULATIONS

20.1 General Compliance Obligations

You acknowledge and agree that you are solely responsible for complying with all applicable laws, regulations, rules, ordinances, statutes, codes, standards, guidelines, and requirements of any governmental authority, regulatory body, or self-regulatory organization having jurisdiction over you, your use of the Service, or your location, including but not limited to: (a) data protection and privacy laws; (b) intellectual property laws; (c) export control laws; (d) anti-spam laws; (e) consumer protection laws; (f) educational laws and regulations; (g) accessibility laws; and (h) any other applicable laws, regulations, or requirements.

20.2 Educational Institution Compliance

If you are accessing or using the Service on behalf of or in connection with an educational institution, you acknowledge and agree that: (a) you are responsible for ensuring that your use of the Service complies with all applicable educational laws, regulations, and requirements, including but not limited to the Family Educational Rights and Privacy Act (FERPA), the Children's Online Privacy Protection Act (COPPA), and other applicable laws; (b) you are responsible for obtaining any necessary consents, authorizations, or permissions from students, parents, guardians, or other parties as required by applicable law; (c) you are responsible for ensuring that any data collected, used, or disclosed through the Service complies with applicable educational privacy laws and regulations; and (d) Unime.Space is not responsible for ensuring that your use of the Service complies with applicable educational laws, regulations, or requirements.

20.3 Accessibility and Accommodation

Unime.Space strives to make the Service accessible to users with disabilities, but you acknowledge and agree that: (a) Unime.Space does not guarantee that the Service is fully accessible or compliant with all accessibility laws, regulations, or standards; (b) you are responsible for ensuring that your use of the Service complies with applicable accessibility laws, regulations, or requirements; (c) if you require accommodations or modifications to access or use the Service, you are responsible for requesting such accommodations or modifications from Unime.Space; and (d) Unime.Space may, in its sole discretion, provide accommodations or modifications, but is not obligated to do so, except as required by applicable law.


SECTION 21: FORCE MAJEURE AND BUSINESS CONTINUITY

21.1 Force Majeure Events

Unime.Space shall not be liable for any failure or delay in performance under these Terms due to causes beyond its reasonable control, including but not limited to: (a) acts of God, natural disasters, earthquakes, floods, fires, storms, or other weather-related events; (b) war, terrorism, riots, civil unrest, acts of civil or military authorities, or other hostilities; (c) embargoes, sanctions, or other governmental actions or restrictions; (d) labor strikes, work stoppages, or other labor disputes; (e) network or equipment failures, power outages, or other technical failures; (f) cyberattacks, security breaches, or other security incidents; (g) pandemics, epidemics, or other public health emergencies; or (h) any other cause beyond Unime.Space's reasonable control.

21.2 Business Continuity and Disaster Recovery

Unime.Space may implement business continuity plans, disaster recovery procedures, or other measures to ensure the continued operation of the Service, but you acknowledge and agree that: (a) Unime.Space does not guarantee that such plans, procedures, or measures will be effective or successful; (b) the Service may be unavailable, inaccessible, or non-functional during or after force majeure events or other disruptions; (c) Unime.Space is not obligated to maintain or restore the Service within any particular timeframe; and (d) Unime.Space shall not be liable for any loss, damage, or harm arising from force majeure events or other disruptions to the Service.

21.3 Service Interruptions and Maintenance

Unime.Space may, from time to time, perform maintenance, updates, upgrades, or other work on the Service that may result in temporary interruptions, unavailability, or reduced functionality. You acknowledge and agree that: (a) Unime.Space may perform such maintenance, updates, upgrades, or work at any time, with or without prior notice; (b) Unime.Space is not obligated to provide advance notice of such maintenance, updates, upgrades, or work; (c) the Service may be unavailable, inaccessible, or non-functional during such maintenance, updates, upgrades, or work; and (d) Unime.Space shall not be liable for any loss, damage, or harm arising from such interruptions, unavailability, or reduced functionality.


SECTION 22: NOTICES AND COMMUNICATIONS

22.1 Methods of Notice

Any notices, communications, or other correspondence required or permitted under these Terms may be provided by Unime.Space to you through various means, including but not limited to: (a) email to the email address associated with your Account; (b) in-service notifications, pop-up messages, banner announcements, or other in-service communications; (c) postal mail to the address associated with your Account, if provided; (d) posting on the Service or Unime.Space's website; or (e) any other method deemed appropriate by Unime.Space in its sole discretion.

22.2 Effective Date of Notices

Notices shall be deemed received: (a) when delivered, if delivered in person or by courier; (b) when received, if sent by email (provided that Unime.Space does not receive a bounce-back or other error message indicating that the email was not delivered); (c) when posted, if posted on the Service or Unime.Space's website; or (d) as otherwise specified in the notice or as required by applicable law.

22.3 Your Responsibility to Update Contact Information

You are solely responsible for ensuring that your contact information, including but not limited to your email address, postal address, and phone number, is accurate, current, and complete. You agree to promptly update your contact information if it changes or becomes inaccurate, incomplete, or outdated. You acknowledge and agree that Unime.Space is not responsible for any failure to receive notices, communications, or other correspondence if you have not provided accurate, current, and complete contact information.

22.4 Electronic Communications

By using the Service, you consent to receive electronic communications from Unime.Space, including but not limited to emails, in-service notifications, and other electronic messages. You acknowledge and agree that: (a) all agreements, notices, disclosures, and other communications that Unime.Space provides to you electronically satisfy any legal requirement that such communications be in writing; (b) you may opt out of certain types of electronic communications by following the procedures set forth in the Service or by contacting Unime.Space; and (c) some electronic communications may be necessary for the operation of the Service and cannot be opted out of.


SECTION 23: SEVERABILITY AND CONSTRUCTION

23.1 Severability of Provisions

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable, or if such modification is not possible, such provision shall be severed from these Terms, and the remaining provisions shall remain in full force and effect. The invalid, illegal, or unenforceable provision shall be replaced with a valid, legal, and enforceable provision that comes closest to the intent of the original provision.

23.2 Construction and Interpretation

These Terms shall be construed and interpreted in accordance with the following principles: (a) headings and section titles are for convenience only and shall not affect the interpretation or construction of these Terms; (b) the use of the singular includes the plural and vice versa; (c) the use of "including" or "includes" means "including without limitation" or "includes without limitation"; (d) references to "you" or "your" include your agents, representatives, and any entity on whose behalf you are acting; (e) references to "Unime.Space," "we," "us," or "our" include Unime.Space's affiliates, subsidiaries, partners, licensors, licensees, service providers, employees, agents, directors, officers, and representatives; and (f) these Terms shall be interpreted in a manner that gives effect to the intent of the parties as expressed in these Terms.

23.3 No Third-Party Beneficiaries

These Terms are for the benefit of you and Unime.Space only, and nothing in these Terms shall be construed as creating any right, benefit, or interest in favor of any third party. No third party shall have any right to enforce any provision of these Terms or to bring any claim against Unime.Space arising out of or in connection with these Terms or your use of the Service.


SECTION 24: ACKNOWLEDGMENT AND ACCEPTANCE

By accessing, browsing, navigating, utilizing, interacting with, downloading content from, uploading content to, registering an account with, authenticating through, subscribing to, or otherwise engaging with any aspect of the Unime.Space platform, you hereby acknowledge, represent, warrant, and agree that:

  1. You have read, understood, comprehended, and fully accept all of the terms, conditions, provisions, stipulations, requirements, restrictions, limitations, obligations, responsibilities, liabilities, disclaimers, exclusions, waivers, releases, indemnifications, and other legal and contractual obligations set forth in this Agreement.

  1. You have the legal capacity, authority, and competence to enter into this Agreement and to use the Service in accordance with these Terms.

  1. You will comply with all applicable laws, regulations, and these Terms in your use of the Service.

  1. You understand that Unime.Space may modify, amend, update, revise, supplement, alter, change, or otherwise edit these Terms at any time, and that your continued use of the Service following such modifications constitutes your acceptance of such modifications.

  1. You understand that Unime.Space provides the Service on an "as is," "as available," and "with all faults" basis, without warranties of any kind, and that you use the Service at your own risk.

  1. You understand that Unime.Space's liability is limited to the maximum extent permitted by applicable law, and that you will indemnify, defend, and hold harmless Unime.Space from and against any claims arising out of or in connection with your use of the Service.

  1. You understand that disputes arising out of or in connection with these Terms or your use of the Service shall be resolved through binding arbitration, except as otherwise provided in these Terms.

  1. You understand that these Terms constitute a legally binding contract between you and Unime.Space, and that violation of these Terms may result in the suspension or termination of your Account and other legal consequences.

If you do not agree to be bound by these Terms in their entirety, you must immediately cease all use of the Service, terminate any existing account, and refrain from accessing or utilizing any aspect of the Platform.
